Se propone un método paradójico para el análisis del Derecho. Este método de conocimiento consiste en una mirada a la complejidad del fenómeno jurídico, presentando sus aspectos complejos en forma de aparentes contradicciones. No son contradicciones reales, sino elementos complejos que, al constatarlos como0 dándose conjuntamente, nos permite dotar de profundidad nuestra reflexión. Hay diferentes maneras de definir la paradoja, pero aquí nos centramos en las cualidades literarias, retóricas y filosóficas que ofrece el tipo o tipos de paradoja utilizados, de (...) forma magistral, por el escritor inglés G.K. Chesterton. De las funciones de las paradojas (desde esta perspectiva, pero no solamente) son especialmente útiles para el análisis jurídico: criticar el sistema de pensamiento y abrir a la realidad. La primera se relaciona con el Derecho porque este siempre está bajo la amenaza del formalismo. La segunda se relaciona con él porque el Derecho es un fenómeno humano, de forma que, cuando hablamos de Derecho, estamos analizando la realidad compleja de la persona humana. Esta nos e puede reducir a una sola de sus dimensiones, y por ello es necesaria la paradoja, para equilibrar los distintos enfoques del análisis. Tras explicar todo esto, se procede en el artículo a sugerir siete paradojas que muestran la complejidad del fenómeno jurídico y pretenden ser retos al pensamiento. (shrink)

En este artículo explico una parte de la labor de G. K. Chesterton como crítico económico: su crítica al sistema capitalista. Con la imagen de la locura (loco sería, no el incapacitado para razonar, sino el que vive fuera de la realidad), considera al capitalismo como una locura porque su discurso es coherente pero no ofrece una vida digna para el ser humano: el capitalismo quita la libertad al proletario, le obliga a desvincularse espiritualmente de su propiedad y le desalienta (...) cuando propone alternativas económicas. BALLESTEROS, Jesús: «Domeñar las finanzas, cuidar de la naturaleza».

Vivimos en una sociedad en la que lo digital lo ha invadido todo. Han se ha ocupado de analizar este cambio desde la perspectiva antropológica y social, con una posición radicalmente crítica. Para Han el medio digital es un medio que nos re-programa. El cambio principal consiste en que desaparece lo que Han llama la “negatividad”. La negatividad aparece como aquello que no es positivo, que no es puesto (positum) por el individuo, sino que le viene dado y se percibe (...) inicialmente como límite. Esa negatividad de lo dado tiene múltiples manifestaciones: es lo no-inmediato, lo extraño, lo otro, lo que produce pesar y resistencia. Esta transformación hacia la transparencia “es una coacción sistémica que se apodera de todos los sucesos sociales y los somete a un profundo cambio”. Esto afecta incluso al hombre mismo, que es convertido también en un elemento funcional del sistema. Han analiza esa coacción violenta de la transparencia digital, y su omnipresencia, desde distintos enfoques a lo largo de sus libros. De ellos hemos seleccionado cinco: las relaciones personales (respeto y confianza), las relaciones comerciales (el mercado), las relaciones políticas y las relaciones con la realidad, mediadas por nuestro entendimiento del espacio y el tiempo. This textbook presents the basics of philosophy that are necessary for the student and researcher in science in order to better understand scientific work. The approach is not historical but formative: tools for semantical analysis, ontology of science, epistemology, and scientific ethics are presented in a formal and direct way. The book has two parts: one with the general theory and a second part with application to some problems such as the interpretation of quantum mechanics, the nature of mathematics, and (...) the ontology of spacetime. The book addresses questions such as "What is meaning?", "What is truth?", "What are truth criteria in science?", "What is a theory?", "What is a model?" "What is a datum?", "What is information?", "What does it mean to understand something?", "What is space?", "What is time?", "How are these concepts articulated in science?" "What are values?" "What are the limits of science?", and many more. The philosophical views presented are "scientific" in the sense that they are informed by current science, they are relevant for scientific research, and the method adopted uses the hypothetical-deductive approach that is characteristic of science. The results and conclusions, as any scientific conclusion, are open to revision in the light of future advances. Hence, this philosophical approach opposes to dogmatic philosophy. Supported by end-of-chapter summaries and a list of special symbols used, the material will be of interest for students and researchers in both science and philosophy. The Introduction goes on to discuss the aims of the book, which is to offer a sustained discussion of intergenerational justice as seen by practical philosophers. The first part of the book focuses on the way in which various schools of thought in moral and political philosophy approach the domain of intergenerational justice, while the second part focuses on more specific aspects, (...) such as how these theories address the question of motivation, how they deal with demographic fluctuations, or how they can be applied to real-world issues such as climate change. In this paper, we explore an under-investigated question concerning the class of formal models that aim at providing normative guidance. We call such models normative models. In particular, we examine the question of how normative models can successfully exert normative guidance. First, we highlight the absence of a discussion of this question – which is surprising given the extensive debate about the success conditions of descriptive models – and motivate its importance. Second, we introduce and discuss two potential accounts of (...) the success conditions of normative models. Our tentative conclusion is that the second account is more promising. (shrink)

Scholars disagree about the plausibility of preference purification. Some see it as a familiar phenomenon. Others denounce it as conceptually incoherent, postulating that it relies on the psychologically implausible assumption of an inner rational agent. I argue that different notions of rationality can be leveraged to advance the debate: procedural rationality and structural rationality. I explicate how structural rationality, in contrast to procedural rationality, allows us to offer an account of the guiding idea behind preference purification that avoids inner rational (...) agents. La presente investigación hace una revisión de la producción académica publicada sobre educación religiosa escolar entre los años 1991-2020 en Hispanoamérica, donde la ERE ha estado presente en los sistemas educativos en estos países a partir de la primera evangelización desde la época de la colonia, cambiando de finalidades, métodos y formatos. Entender su lugar en la escuela actual requiere identificar los cambios históricos, de contexto y finalidad, y las distintas preocupaciones de sus actores educativos. La investigación hace una revisión (...) general de las publicaciones de la región, puntualizando en el caso colombiano, argentino, mexicano y uruguayo. La metodología usa un análisis de contenido que identifica tres niveles de análisis del texto: de superficie, analítico e interpretativo. Los hallazgos se clasificaron en cinco temáticas: 1) análisis jurídicos; 2) estudios historiográficos; 3) análisis sobre las nuevas realidades sociales y educativas; 4) análisis de los currículos y la práctica pedagógica del maestro; y, 5) fundamentación epistemológica de la ERE. La revisión permite concluir que el tipo de educación religiosa escolar de cada país en Hispanoamérica está determinado por la comprensión de laicidad que cada país tenga en su ordenamiento constitucional y por las complejas trayectorias históricas de las relaciones Iglesia – Estado en su consolidación como nación. Además, los documentos dan cuenta de diversidad de enfoques y preocupaciones por la necesidad –o no- de una educación religiosa fundamentada teológica y pedagógicamente, para un contexto religioso y cultural claramente diverso y plural en el cual se encuentran jóvenes y adolescentes que asisten a la escuela, algunos en búsqueda de identidad y sentido de vida. En los Estados Unidos, típicamente desde la década de los 70’s, los instructores que se enfrentan al dilema sobre qué método es más conveniente para la enseñanza de una segunda lenguas. La aparente causa puede ser la confusión pedagógica sobre el término de competencia y la enseñanza de las reglas gramaticales. Los instructores han recurrido al método cognitivo por figurar éste como la alternativa viable e inmediata para tal propósito. Sin embargo, la literatura especializada muestra que el tema sobre los (...) métodos de instrucción de lenguas extranjeras resulta ser un problema más complejo que el de una simple elección, particularmente cuando se percibe que el propósito del estudiante no es sino sólo lograr el manejo de un idioma extranjero para la comunicación en todos los ámbitos y para cuestiones académicas y profesional, lo que involucra distinguir entre adquirir una lengua y aprenderla. Functionalism about kinds is still the dominant style of thought in the special sciences, like economics, psychology, and biology. Generally construed, functionalism is the view that states or processes can be individuated based on what role they play rather than what they are constituted of or realized by. Recently, Weiskopf has posited a reformulation of functionalism on the model-based approach to explanation. We refer to this reformulation as ‘new functionalism’. In this paper, we seek to defend new functionalism and to (...) recast it in light of the concrete explanatory aims of the special sciences. In particular, we argue that the assessment of the explanatory legitimacy of a functional kind needs to take into account the explanatory purpose of the model in which the functional kind is employed. We aim at demonstrating this by appealing to model-based explanations from the social and behavioral sciences. Specifically, we focus on preferences and signals as functional kinds. Our argument is intended to have the double impact of deflecting criticisms against new functionalism from the perspective of mechanistic decomposition while also expanding the scope of new functionalism to encompass the social and behavioral sciences. BackgroundMoral distress (MD) is the psychological damage caused when people are forced to witness or carry out actions which go against their fundamental moral values. The main objective was to evaluate the prevalence and predictive factors associated with MD among health professionals during the pandemic and to determine its causes.MethodsA regional, observational and cross-sectional study in a sample of 566 professionals from the Public Health Service of Andalusia (68.7% female; 66.9% physicians) who completed the MMD-HP-SPA scale to determine the level (...) of MD (0-432 points). Five dimensions were used: i) Health care; ii) Therapeutic obstinacy-futility, iii) Interpersonal relations of the Healthcare Team, iv) External pressure; v) Covering up of medical malpractice.ResultsThe mean level of MD was 127.3 (SD=66.7; 95% CI 121.8-132.8), being higher in female (135 vs. 110.3; p<0.01), in nursing professionals (137.8 vs. 122; p<0.01) and in the community setting (136.2 vs. 118.3; p<0.001), with these variables showing statistical significance in the multiple linear regression model (p<0.001; r2=0.052). With similar results, the multiple logistic regression model showed being female was a higher risk factor (OR=2.27; 95% CI 1.5-3.4; p<0.001). 70% of the sources of MD belonged to the dimension "Health Care" and the cause "Having to attend to more patients than I can safely attend to" obtained the highest average value (Mean=9.8; SD=4.9).ConclusionsFemale, nursing professionals, and those from the community setting presented a higher risk of MD. The healthcare model needs to implement an ethical approach to public health issues to alleviate MD among its professionals. (shrink)

On a highly influential way to think of modality, that I call ‘relationalism’, the modality of a state is explained by its being composed of properties, and these properties being related by a higher-order and primitively modal relation. Examples of relationalism are the Dretske-Tooley-Armstrong account of natural necessity, many dispositional essentialist views, and Wang’s incompatibility primitivism. I argue that relationalism faces four difficulties: that the selection between modal relations is arbitrary, that the modal relation cannot belong to any logical order, (...) that to explain how the modal relation can relate properties of different adicities additional ideological complexity has to be introduced, and that not all modal constraints are relational. From the discussion, I will extract desiderata for a successor theory of modality. (shrink)

Transformar el modo de vida individual es necesario para abordar la crisis ecosocial, y resulta perentorio que las políticas comprometidas con su resolución promocionen una capacidad individual de acción ecosocial. Sin embargo, parece que cierta brecha motivacional está obstaculizando la transformación del modo de vida individual. A fin de dar respuesta a esta brecha, ensayamos una mixtura del enfoque de las capacidades con las teorías de Hartmut Rosa. Argumentamos que la resonancia natural funge de factor personal de conversión necesario, si (...) bien no suficiente, para la capacidad de acción ecosocial; y que una política que promocione la resonancia natural se adecuaría también a los requisitos impuestos al desarrollo humano tanto por el enfoque de las capacidades como por la sostenibilidad. When economists perform experiments, they do so typically in one of two traditions: cognitive psychology experiments in the heuristics and biases tradition (H&B-experiments) and experimental economics in the tradition of Vernon Smith. What sets these two traditions apart? In this paper, I offer a novel conceptualization of their pervasive disagreements. Focusing on how each camp approaches preferences, one of the most fundamental concepts in economics, I argue that experimental economics can be reconstructed as holding that the constituents of preferences can (...) be partially located in agents’ environments, while H&B-experiments implicitly assume that the constituents of preferences are entirely located within agents’ bodies. The paper (i) outlines how my reconstruction can account for the disagreement between the two paradigms, (ii) defends the plausibility of this reconstruction, and (iii) highlights its implications for the debate about the nature of preferences in economics. Explication usually plays the role of the method of language revision. The paper sticks to the Carnapian project of explication and develops some of the formal requirements imposed on the explicatum. However, it departs from Carnap’s view when it comes to how to construe the simplicity condition. It is suggested that in some cases the simplicity condition, which in the Carnapian project plays the derived role with respect to the other three conditions—the similarity, exactness, and fruitfulness conditions—may be substantive for (...) the overall evaluation of explications. Based on a case study of three different explications of the H-D concept of confirmation :391–437, 1991; Erkenntnis 41:183–188, 1994; Gemes in Philos Sci 60:477–487, 1993; Erkenntnis 49:1–20, 1998; Sprenger in Philos Compass 6:497–508, 2011), we show that there are cases where competing explicata of a common explicandum satisfy the first three conditions equally well. In those cases, then, the simplicity condition is supposed to make the difference. However, instead of using Carnap’s construal of simplicity, we suggest a Principle of instrumental simplicity according to which, ceteris paribus, the simpler the explicatum is, the more likely is its ‘survival’ in competition with other explicata. Moreover, it is suggested that whereas the similarity, exactness and fruitfulness conditions are, in some sense, formal criteria, the simplicity condition is rather tested empirically. (shrink)

My aim in this note is to shed light on ways of interpreting Kant’s Formula of Universal Law (FUL), by looking at relevant similarities and differences between Pauline Kleingeld and Mark Timmons. I identify both their readings as a formal interpretation of Kant’s FUL, in contrast to the substantive interpretations that favor a robust conception of rational agency as a necessary requirement for moral deliberation. I highlight the benefits that arise from Kleingled’s interpretation in showing the immediacy involved in the (...) volitional self-contradiction when universalizing a maxim. Alongside Timmons, I address a question as to whether Kleingeld’s interpretation is completely free from at least a minimal set of assumptions about practical deliberation more broadly, that seem to play a role in generating the volitational self-contradiction she is defending. I close by raising some skeptical worries about the capacity of this kind of contradiction to translate into a moral judgment triggering action. (shrink)

A realistic axiomatic formulation of nonrelativistic quantum mechanics for a single microsystem with spin is presented, from which the most important theorems of the theory can be deduced. In comparison with previous formulations, the formal aspect has been improved by the use of certain mathematical theories, such as the theory of equipped spaces, and group theory. The standard formalism is naturally obtained from the latter, starting from a central primitive concept: the Galilei group.

My aim in this paper is to argue that the recent philosophical defenses of revealed preference theory do not withstand scrutiny. Towards this aim, I will first outline revealed preference theory. I will then briefly present the two most common arguments that the received view offers against it. Afterwards, I will outline three argumentative strategies for rehabilitating revealed preference theory, and successively rebut each of them.

The concept of ideology is central to the understanding of the many political, economic, social, and cultural processes that have occurred in the last two centuries. And yet, what is the nature of the different ideologies remains a vague, open, and much disputed question. Many political, sociological, and ideological studies have been devoted to ideology. Very little, on the other hand, has been done from the philosophical field. And this despite the fact that there are undoubtedly many philosophical questions related (...) to ideology and its role in modern industrialized societies. Just a few examples of ideology-related philosophical questions suffice to prove the point: What objects do ideologies deal with? Are the ideologies testable? Are there true ideologies? Do they evolve? How are ideologies related to societies? Is the existence of ideologies inevitable in modern societies? What is the relation of ideology to science? Is science just another kind of ideology? Are we, as human beings, innately predisposed to believe in ideologies? Or, instead, ideologies proliferate through indoctrination and propaganda? Are ideologies necessarily harmful?...and much more. In this article I try to answer some of these questions from a philosophical point of view, taking a materialist approach. I begin by characterizing ideology as a complex, multi-layered concept. Then, I briefly discuss the material systems on which ideological movements operate, that is, societies and concrete human groups. I identify at least 11 different elements that seem to be present in most ideologies, and I compare these characteristics with those of contemporary science and technology. Although some superficial similarities can be identified, there are deep differences that make ideology completely different from science. The similarities, however, are stronger with technology. Ideologies continually evolve with technological advances, social changes, and even with mere fashion. The current fragmentation of ideologies caused by the widespread use of new technologies and social networks has given rise to new phenomena of ideological propagation which, in my opinion, are very dangerous, particularly for open societies. I discuss these processes, within the context of the nature vs nurture debate, along with the question of whether we can get rid of ideologies. (shrink)

I argued against relationalism with four objections. One of those was that, under reasonable assumptions, relationalism's modal relation needs to be what I called an `extra order' relation. I recently came to notice that the objection could have been posed with much less substantive assumptions. In particular, I recently noticed that order-dissonant predications are not required for the objection; therefore, noncumulativism is not relevant for my argument.

Explikácia patrí medzi kľúčové metódy analytickej filozofie. V tejto práci predstavujem návrh explicitného odlíšenia metódy explikácie od jej výsledku. V nadväznosti na prácu Rudolfa Carnapa sa snažím jeho explikačný projekt rozvinúť. Poukazujem na otvorené problémy Carnapovych kritérií adekvátnej explikácie; ukazujem, v čom sa explikácie od definícií líšia, aká je ich logická forma a ktoré explicitné kroky sú typické pre metódu explikácie. Napokon, približujem dôvody, pre ktoré je možné explikáciu chápať ako reláciu nahradenia medzi významovou charakterizáciou a definíciou určitého druhu.

The demand for meat and dairy products is expected to rise significantly in the current demographic and economic growth context. Concurrently, various factors, including financial crises and reduced profitability, have decreased the number of livestock farms. Consequently, the livestock industry is undergoing intensification, with an increased number of cows per farm. This shift makes the management of animals increasingly complex. Amid these challenges, the society’s growing concern for animal health and welfare and the quality of consumed products underscores the importance (...) of systems that aid in the individual and herd-level monitoring and control within livestock operations. In this scenario, precision livestock farming has become essential with the emergence of new sensors and technologies and the evolution of artificial intelligence. Against this backdrop, this paper reviews systems and techniques used in precision livestock farming to detect anomalies caused by reproductive processes and diseases in dairy and beef cattle. The article analyzes sensors and technologies employed, presents key studies conducted, and discusses the most commonly used artificial intelligence techniques in detecting prevalent anomalies. Teaching and research are organised differently between subject domains: attempts to construct typologies of higher education institutions, however, often do not include quantitative indicators concerning subject mix which would allow systematic comparisons of large numbers of higher education institutions among different countries, as the availability of data for such indicators is limited. In this paper, we present an exploratory approach for the construction of such indicators. The database constructed in the AQUAMETH project, which includes also data disaggregated at the disciplinary (...) level, is explored with the aim of understanding patterns of subject mix. For six European countries, an exploratory and descriptive analysis of staff composition divided in four large domains (medical sciences, engineering and technology, natural sciences and social sciences and humanities) is performed, which leads to a classification distinguishing between specialist and generalist institutions. Among the latter, a further distinction is made based on the presence or absence of a medical department. Preliminary exploration of this classification and its comparison with other indicators show the influence of long term dynamics on the subject mix of individual higher education institutions, but also underline disciplinary differences, for example regarding student to staff ratios, as well as national patterns, for example regarding the number of PhD degrees per 100 undergraduate students. Despite its many limitations, this exploratory approach allows defining a classification of higher education institutions that accounts for a large share of differences between the analysed higher education institutions. Sacrifice haunts the Phaedo. In this article, I argue that the mise-en-scène of the death scene of the Phaedo, as well as other sacrificial elements in the background of the dialogue, creates a nexus that positively integrates the birth, philosophical practice, and death of Socrates into the ritualized rhythm of the life of the city of Athens. A close reading of the death scene presented as a synopsis with Walter Burkert’s well-known analysis of Greek sacrifice reveals convergences and divergences between (...) the Phaedo and Greek sacrificial practice. Socrates appears as a willing victim who accepts the city’s sacrificial practice while remaining on his own terms. (shrink)

Comenzamos este texto con una pregunta, por algo que podríamos llamar un signo propio de la época, a saber, la proliferación de aproximaciones espaciales a los más diversos problemas y desde las más diversas disciplinas. No podemos dejar de notar que eso, cuyos signos se dejan recoger a pesar de su dispersión, en algo que llamamos época, sobreviene después de un agotamiento de la radicalización del historicismo y de un pensamiento del tiempo.

Ofrezco una justificación breve del valor de la actividad científica y una vindicación de su defensa.

Para la estética, la creatividad es la emergencia del instante que la vuelve irrepetible o un transitar pendular que la hace resurgir como reminiscencia cegada por un ocaso repetitivo. Haciendo coincidir proceso y teleología, Peirce aglutina estas dos dimensiones, sin atisbar realmente un atisbo de humanidad para disfrutar de lo ínfimo. De ahí que propongamos un momento oportuno que nos dirija hacia una temporalidad más humana.

Média zaznamenávají dynamický rozvoj společně s vývojem technologií a jsou základem, ale mohou být i destruktorem, společenského řádu potažmo demokracie. Tato stať se nejprve zaměřuje na prozkoumání obsahu médií z nadhledu odlišných teoretiků Lévyho a Thompsona, aby následně tyto poznatky zasadila do kontextu společenského řádu a demokracie.

Stať se zabývá modelováním demokracie jakožto popisu politického systému; David Held je jedním z autorů, který nabízí obecné modely demokracie, jež náleží příslušným společnostem a jejich tradicím. Jelikož má Česká republika specifický demokratický systém, pokouší se tato stať za pomoci syntetizace Heldových modelů co nejvýstižněji popsat současnou českou demokracii. Model kombinuje znaky ústavnosti v jejich formální podobě a reálné politické chování. Následně se snaží nalézt pozici demokracie ve společenském řádu za pomoci Hayekova pohledu na tuto tematiku.
